The Small Claims Mediation Service is a free service provided by the Courts for claims within the small claims track (i.e. up to £10,000). To qualify for mediation all parties involved must agree to be part of the process.
During the mediation process, a trained and neutral mediator will contact each party in turn to establish the facts of the dispute and to encourage compromise. It is expected that each party should have some room for movement on their original position. If the matter is settled by mediation then the agreement becomes and legally enforceable agreement and if one party does not adhere to its terms, they can make an application to the Court to enforce it.
